These Terms of Use ("Terms") govern your use of the PakistanTutor website and services("Site") provided by PakistanTutor, Inc. ("PakistanTutor"). Please read these Terms before using or continuing to use the Site. Do not agree to the Terms unless you both fully understand and accept each one. By using or continuing to use the Site, you represent and warrant that you understand, agree to, and accept all terms and conditions contained in this document.
1. General terms
PakistanTutor provides this Site to users seeking tutoring services (‚ÄúStudents‚Ä?) and to users seeking to provide tutoring services (‚ÄúTutors‚Ä?), and to any other entity on whose behalf users accept these Terms (collectively "you"). These Terms are entered into by and between PakistanTutor and you, and you accept them by: (a) contracting for tutoring lessons through the Site; (b) using the Site in any other manner; and/or (c) acknowledging agreement with these Terms. If you do not agree to these Terms, do not use the Site.
To the extent that anything in or associated with the Site is in conflict or inconsistent with these Terms, the Terms shall control. Any express waiver or failure to exercise promptly any right under the Terms will not create a continuing waiver or any expectation of non-enforcement. If any provision of the Terms is held invalid by any law or regulation of any government, or by any court or arbitrator, the parties agree that such provision will be replaced with a new provision that accomplishes the original business purpose, and the other provisions of the Terms will remain in full force and effect.
2. Services
Pakistantutor.com works as a marketplace for tutors, students and tuition centres. Tutors can make their online profile with and without some limitations and may set their own hourly and monthly fee. Students can make their profile or can directly hire a tutor (Fee applies to both tutor and student), can post learning requirement to hire home and online tutors. Tuition centres can make their profile and display their profile as company profile on our tuition centre page.

3. Academic honesty
You acknowledge and agree that PakistanTutor's services are provided for the purpose of learning, not cheating. You are not to inquire or hire tutors to complete assignments, write papers, take quizzes or otherwise do work on your behalf. Further, you are not to use PakistanTutor's services for any purpose that violates the academic honesty policy or other conduct policies of your school, university, academic institution or workplace.
4. Your obligations and conduct
In consideration of your use of the Site, you agree:
1 - that you are of legal age and have capacity to agree to these Terms;
2 - to provide accurate, current, and complete information about you as may be prompted by a registration form on the website ("Registration Data");
3 - to maintain the security of your password and identification;
4 - to maintain and promptly update the Registration Data and any information you provide to PakistanTutor, to keep it accurate, current and complete; and
5 - to accept all risks of unauthorized access to information and Registration Data.
6 - You are entirely responsible for all Content that you upload, post, or otherwise transmit through your use of the Site ("Content"). You agree not to upload, post or otherwise transmit Content that:
a - is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to PakistanTutor or other users of the website;
b - includes unauthorized disclosure of personal information;
c - violates or infringes anyone's intellectual property rights; or
d - contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. PakistanTutor reserves the right to edit or remove Content that violates these Terms, that contains third-party commercial advertisements, or for any other reason it deems necessary.
Use of Website
You agree to use the Site in a manner that is lawful, relevant and proper to the applicable forum. Any use of the Site that PakistanTutor, in its sole discretion, finds inappropriate and/or offensive may result in suspension and/or termination of a user with or without notice.
Defame, abuse, harass, harm, stalk, threaten or otherwise violate the legal rights (including without limitation rights of privacy and publicity) of others;
1 - Publish, post, upload, distribute or disseminate any profane, defamatory, infringing, hateful, distasteful, obscene or unlawful topic, name, information, materials or content;
2 - Use the Site for any purpose that is in violation of local, state, national, or international law, including without limitation wage/hour and working condition laws and regulations;
3 - Upload files that contain software or other material that violates the rights of any third party, including without limitation intellectual property rights or rights of privacy or publicity;
4 - Upload files that contain viruses, Trojan horses, worms, time bombs, spiders, cancel bots, corrupted files, or any other similar software, malware or materials that may damage, interfere with, disrupt, impair, disable or otherwise overburden the operation of any device, computer system or network;
5 - Take any action that would undermine any aspect of the Site;
6 - Attempt to gain unauthorized access to the Site, other User accounts, or other device, computer system or networks connected to the Site;
7 - Advertise or offer to sell any goods or services for any commercial purpose on the Site that are not appropriate or relevant to the Site;
8 - Impersonate another person or allow any other person or entity to use your user name, password or membership;
9 - Post the same content repeatedly or spam - spamming is strictly prohibited;
10 - Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed through the Site;
11 - Access, download, or copy any information, content and/or materials from the Site through artificial means (including without limitation spiders, scrapers, hacking devices, computer programs, bots or other such means);
12 - Reproduce, duplicate, copy, sell, re-sell or exploit any information, materials or content on the Site; or
13 - Restrict or inhibit any other user from using and enjoying the Site.
By using the site, you represent and warrant that you currently meet and will continue to meet the following eligibility conditions ("Eligibility Conditions") for as long as you use the Site:
a - you have and will at all times comply with all laws and regulations;
b - you have the right, authority and capacity to enter into these Terms of Use and to abide by all of terms and conditions in these Terms of Use;
c - neither you, nor anyone in your home:
i - has been the subject of a complaint, restraining order or any other legal action involving violence, abuse, neglect, fraud, larceny, or any offence that involves endangering the safety of others;
ii - has been convicted of a crime of any nature, including any felony or misdemeanour's of any kind, including without limitation any sexual, child abuse or domestic violence offences; and/or
iii - has been and/or is currently required to register as a sex offender in any jurisdiction or with any government entity; and
d - neither you, nor anyone in your home, is currently out on bail or on your own recognizance pending trial, relating to any felony or misdemeanour's charges of any kind, including without limitation sexual, child abuse or domestic violence offences.
Truthfulness of your information
By using the Site, you understand and agree that PakistanTutor may rely on the above Eligibility Conditions representations and warranties as true. You understand and agree that PakistanTutor may revise the Eligibility Conditions from time to time and require new conditions and certifications and that User will abide by such revised Eligibility Conditions or discontinue using the Site.
Verification of your information
You hereby authorize PakistanTutor to verify the above representations and warranties by you and you acknowledge and agree that PakistanTutor shall have the right, but not the obligation, to verify such representations and warranties. You agree and understand that such verification may include, without limitation, conducting criminal background checks, sex offender registry checks, motor vehicle records checks, identification verifications, credit checks and/or use of available public records. You consent to any collection, use or disclosure in order to accomplish such verification. You further agree that PakistanTutor may take such action as it, in its sole discretion, deems appropriate, including without limitation suspending and/or terminating your use of the Site, should it determine that you have violated any representation or warranty.
The preceding paragraph notwithstanding, you understand and agree PakistanTutor does not conduct background checks of any user. You also understand and agree PakistanTutor neither confirms nor denies the validity of information provided by users and that PakistanTutor does not verify that any or all of the Eligibility Conditions are met by users. You understand and agree to make your own decisions and assessments about persons to engage and that IT IS YOUR SOLE RESPONSIBILITY TO CONDUCT ANY AND ALL BACKGROUND AND REFERENCE CHECKS REGARDING OTHER USERS.
PakistanTutor expressly disclaims, and you expressly release PakistanTutor from, any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages arising from and/or in any way related to:
1 - any inaccuracy, untimeliness or incompleteness regarding a user's Eligibility Conditions and/or
2 - misstatements or misrepresentations made by any user.
PakistanTutor reserves all of its rights, including without limitation its right to remove anything objectionable to PakistanTutor in its sole discretion. Alleged improprieties by any User may be reported to PakistanTutor by email at [email protected].
5. Third party reports
PakistanTutor may utilize third party consumer reporting agencies that perform, among other things, criminal background checks, sex offender registry checks, motor vehicle records checks, credit checks, and identification verifications ("consumer reports"). PakistanTutor does not endorse or make any representations or warranties regarding the reliability of such consumer reports or the accuracy, timeliness or completeness of any information in the consumer reports. PakistanTutor does not independently verify information in the consumer reports.
You hereby consent to PakistanTutor collecting, using and disclosing the information in the consumer reports. You understand and agree that PakistanTutor may, in its sole discretion, review and rely on the information in the consumer reports in deciding whether to suspend or terminate a user or to investigate a complaint about a user, but that PakistanTutor shall not be responsible or liable in any way in the event that any information in the consumer reports about any person, including without limitation any user, is not accurate, timely or complete. Users who are the subject of consumer reports may contact the service provider to dispute the accuracy, timeliness or completeness of such information. PakistanTutor reserves the right to suspend and/or terminate User based on information in the consumer reports or for any other reason in PakistanTutor's sole discretion.
6. Confidentiality of PakistanTutor information
You may obtain direct access via the Site to certain confidential information of PakistanTutor and its affiliates, including without limitation technical, contractual, product, program, pricing, marketing and other valuable information that should reasonably be understood as confidential ("Confidential Information"). You must hold Confidential Information in strict confidence. Title to Confidential Information remains with PakistanTutor and its affiliates.
The Terms impose no obligation upon you with respect to Confidential Information that you can establish by legally sufficient evidence:
1 - you possessed prior to your receipt from PakistanTutor, without an obligation to maintain its confidentiality;
2 - is or becomes generally known to the public through no act or omission by you, or otherwise without violation of the Terms;
3 - you obtained from a third party who had the right to disclose it, without an obligation to keep such information confidential;
4 - you independently developed without the use of Confidential Information and without the participation of individuals who have had access to it, or
5 - in response to a valid order by a court or other governmental body, as otherwise required by law, or as necessary to establish the rights of either party under these Terms and as disclosed after prior notice to PakistanTutor adequate to afford PakistanTutor the opportunity to object to the disclosure.
7. Content submitted to the site
PakistanTutor does not claim ownership of the Content that you place on the website and shall have no obligation of any kind with respect to such Content. Unless otherwise stated herein, any Content that you provide in connection with this website shall be deemed to be provided on a non-confidential basis. PakistanTutor shall be free to use or disseminate such Content on an unrestricted basis for any purpose, and you grant PakistanTutor an irrevocable, worldwide, royalty-free, nonexclusive license to use, reproduce, modify, distribute, transmit, display, perform, adapt, resell and publish such Content (including in digital form). You represent and warrant that you have proper authorization for the worldwide transfer and processing among PakistanTutor, its affiliates, and third-party providers of any information that you may provide on the Site.
8. Terms of transacting business
You understand and agree to abide by PakistanTutor’s tutor and student payment policies. You agree that you are willing to pay all costs through PakistanTutor. These costs include but are not limited to:
1 - hourly rate as listed;
2 - travel and transportation fees;
3 - cancellation fees as described in a tutor’s cancellation policy, which can be found on a tutor’s profile on the Site; and
4 - the commission arrangement between the tutor and PakistanTutor.
09. Advertisements and promotions
PakistanTutor may run advertisements and promotions from third parties on the Site. Your correspondence or business dealings with, or participation in promotions of, advertisers other than PakistanTutor found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. PakistanTutor is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such non-PakistanTutor advertisers on the Site.
10. Content provided via links
You may find links to other websites or resources on the Site. You acknowledge and agree that PakistanTutor is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. PakistanTutor will not be responsible or liable, directly or indirectly, for any actual or alleged damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
11. Intellectual property rights
Except as expressly authorized by PakistanTutor or by Content providers, you agree not to reproduce, modify, rent, lease, loan, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works of the Content of others, in whole or in part, by any means. You must not modify, decompile, or reverse engineer any software PakistanTutor discloses to you, and you must not remove or modify any copyright or trademark notice, or other notice of ownership.
"PakistanTutor Trademarks" means all names, marks, brands, logos, designs, trade dress, slogans and other designations PakistanTutor uses in connection with its products and services. You may not remove or alter any PakistanTutor Trademarks, or co-brand your own products or material with PakistanTutor Trademarks, without PakistanTutor's prior written consent. You acknowledge PakistanTutor's rights in PakistanTutor Trademarks and agree that any use of PakistanTutor Trademarks by you shall inure to PakistanTutor's sole benefit. You agree not to incorporate any PakistanTutor Trademarks into your trademarks, service marks, company names, internet addresses, domain names, or any other similar designations, for use on or in connection with computer or internet-related products, services or technologies.
Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppels, implication, or otherwise. Permission is granted to display, copy, distribute and download Content owned by PakistanTutor on this Site provided that:
1 - the copyright notice pertaining to the Content remains, and a permission notice (e.g., "used with permission") is added to such Content;
2 - the use of such Content is solely for personal and non-commercial use;
3 - such Content will not be copied or posted on any networked computer or published in any medium, except as explicitly permitted by valid permission or license covering such materials; and
4 - no modifications are made to such Content. This permission terminates automatically without notice if you breach any of the terms or conditions in this document. Upon termination, you must immediately destroy any downloaded and/or printed Content.
12. Reviews
12.1 You can review a Tutor with whom You have undertaken a Session. Reviews are published in the sole and absolute discretion of PakistanTutor. PakistanTutor may summarise, abbreviate and/or rephrase any review submitted by You. PakistanTutor may decline to publish a review where PakistanTutor considers in its sole and absolute discretion that the review is unfair, inaccurate or otherwise where there is a dispute with the Tutor.
12.2 By writing and submitting a Review, You grant to PakistanTutor an irrevocable licence to publish such review in full or abbreviated form on the Website or any other medium including without limitation its social networking profiles.
12.3 PakistanTutor will never publish Your full name in connection with any review without your prior consent.
13. Intellectual property
13.1 PakistanTutor and/or its licensor(s) are the sole owners of the Website.
13.2 PakistanTutor brand and the Website are protected by Pakistan and International copyright and other intellectual property laws. We permit You to use the Materials for non-commercial use only and we grant You a limited license solely for that purpose. With limitation, this means that You may not sell, license, modify, copy, distribute or transmit the Website (or any part of it) or any material provided through the Website or as part of the Services for any commercial purpose or for any other reason without PakistanTutor’s prior express written consent.
13.3 Materials provided by a Tutor and any concepts, models or other tutoring tools shall belong to the Tutor. The Tutor grants the Student a limited revocable licence to use such material solely for the purposes of participating in the Tutor sessions. Without limitation You may not distribute, copy, sell or otherwise use any such material without the prior written consent of the Tutor.
13.4 You are not permitted to record any Tutor session under any circumstances. Any recording of any Tutor session shall belong to PakistanTutor and shall not be reproduced for any reason without the prior written consent of PakistanTutor.
13.5 Any unauthorized use of the Website will result in the automatic termination of the limited license granted by us. PakistanTutor reserves the right to terminate the limited license without notice at any time following an unauthorized use by You of the Website.
13.6 PakistanTutor and its graphics, logos, icons and service names related to the Website are registered and unregistered trademarks or trade dress of PakistanTutor. They may not be used without PakistanTutor’s prior express written permission.
13.7 All other trademarks not owned by PakistanTutor that appear in connection with the Website are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by PakistanTutor.
14. Electronic communications
14.1 You consent to receiving electronic communications and notices from PakistanTutor and any Tutor with whom You book a Free Trail or purchase one or more Sessions. You agree that any notice, agreement, disclosure or other communications that we send to You electronically will satisfy any legal communication requirements, including that such communications be in writing.
15. Privacy
15.1 You provide us with information when You register on the Website and/or use the Services. We may store such information and use it to improve the Services we provide through the Website. Any information that You submit or that we collect when You are using the Website is subject to PakistanTutor Privacy Policy, the terms of which are hereby incorporated into these Terms of Service.
15.2 PakistanTutor continually tries to keep all information secure from unauthorised access by using SSL encryption on sensitive data. However, transmission over the Internet cannot be guaranteed to be 100% secure, so any information You submit is done so at Your own risk.
15.3 Whilst we have implemented commercially reasonable technical and organisational measures to secure Your personal information from unauthorised use, we cannot guarantee that unauthorised third parties will never be able to defeat those measures. You acknowledge that You provide Your personal information at Your own risk.
16. No warranty and liability limit
16.1 PakistanTutor provides the Website "as is" and without any warranty or condition, whether express, implied or statutory. PakistanTutor specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement to the extent permissible under the Sale of Goods Act 1979 (as amended).
16.2 PakistanTutor assumes no liability or responsibility for any errors or omissions in the Website; any losses or damages arising from the use of the Website and/or the Services; or any harm to Your reputation or losses resulting from any disclosure of information about You by us as permitted in these Terms of Service. We reserve the right to deliver the Website and the Services in our sole and absolute discretion.
16.3 PakistanTutor is not responsible for the provision of Tutor Sessions by Tutors.
16.4 In no event shall PakistanTutor, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to You for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the Website, the Services or these Terms of Service, on any theory of liability, and whether or not advised of the possibility of damage.
16.5 PakistanTutor does not seek to exclude liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation on the part of PakistanTutor. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
16.6 From time to time You may use or access services, promotions and websites of third parties. In using or accessing third party services, promotions and websites, You agree to be bound by the terms of service of such third parties governing their services, promotions and websites and hereby acknowledge that we shall not be responsible for the provision of services, accuracy of promotions or content of websites belonging or operated by third parties.
16.7 PakistanTutor specifically excludes liability for any loss, harm, distress or damage suffered by You or any third party as a result of inaccurate information appearing on the Website.
16.8 Use of a Tutor is no guarantee of a certain result. No Tutor offers any guarantee that a Student using his services will reach a particular standard or pass any examination. By using the Website and any Tutor, You irrevocably disclaim any claim You may have against such Tutor in respect of the quality of tutoring provided by the Tutor and/or the content, format, method or other approach to any tutoring session provided by such Tutor.
17. Interruptions and suspension of the website
17.1 PakistanTutor does not guarantee the uninterrupted operation and availability of the Website. From time to time, the Website may be unavailable for any number of reasons including without limitation:
(a) the performance of scheduled maintenance including on servers and data lines;
(b) the performance of emergency unscheduled maintenance and/or repairs including on servers and data lines;
(c) a failure by or error in respect of any service provider including without limitation any server or data line;
(d) an attack on the security or system integrity of the Website including any denial of service attack; and
(e) the introduction or presence of any virus or malicious code in the pages that make up or are accessible from the Website.
17.2 For the avoidance of doubt, without prejudice to the provisions of paragraph 15, PakistanTutor shall not be liable for and specifically disclaims any liability in respect of any claims, costs, losses or damages suffered as a result of any suspension or interruption to the Website howsoever caused.
18. Indemnity
You agree to indemnify and hold PakistanTutor and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of Your breach of these Terms of Service and/or Your violation of any law or the rights of any third party.
19. Disputes
19.1 You agree that these Terms of Service and any claim, dispute or controversy arising out of in connection with these Terms of Service or their subject matter or formation (including non-contractual disputes or claims), the Website, PakistanTutor’s advertising or any related transaction between You and PakistanTutor shall be governed by and construed in accordance with English law.
19.2 Any dispute or claim arising out of or in connection with such matters (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales.
20. Termination
PakistanTutor may change or discontinue the availability of the Website or any part thereof at any time without prior notice. PakistanTutor reserves the right to terminate these Terms of Service for any reason, without notice, and these Terms of Service shall automatically terminate in the event that You violate any of the Terms of Service set forth herein (with prejudice to our accumulated rights against You). In the event of any termination, You will immediately cease use of the Website.
21. General
21.1 You agree that these Terms of Service and any claim, dispute or controversy arising out of in connection with these Terms of Service or their subject matter or formation (including non-contractual disputes or claims), or the Website or the Services shall be governed by and construed in accordance with English law. Any dispute or claim arising out of or in connection with such matters (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales.
21.2 PakistanTutor may change or discontinue provision of the Services or the Website at any time without prior notice. We reserve the right to terminate these Terms of Service for any reason, without notice, and these Terms of Service shall automatically terminate in the event that You violate any of the terms of Service set forth herein (without prejudice to our accumulated rights against You). In the event of any termination, You will immediately cease use of the Services and Website.
21.3 These Terms of Service are agreed between You and us. No person shall have any rights under or connection with these Terms of Service under the Contracts (Rights of Third Parties) Act 1999.
21.4 If any court or competent authority decides that any term of these Terms of Service is held to be invalid, unlawful or unenforceable to any extent, such term shall, to that extent only, be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by law.
21.5 Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section.
21.6 Our failure to enforce any provision of these Terms of Service shall not constitute a waiver of that or any other provision and will not relieve You from the obligation to comply with such provision.

Use of PakistanTutor.com
The use of the Website by a Tutor, Tutorial centre or a Student shall be deemed acceptance of and agreement to these terms only.
Purpose of Pakistantutor.com
The Website has been established to allow Students to contact Tutors or Tutorial centres and to view their profiles detailing a Tutor's experience. We do not issue any experience certificate to our registered members.
Racism is not allowed
Tutors and tuition centres are not allowed to include any kind of racist content in their profile. Pakistantutor reserves the right to delete, remove, edit or ban any such profile at its own discretion.
Security of Your data
PakistanTutor.com will take all reasonable precautions to keep the details of Tutors and Students secure but will not be liable for unauthorized access to the information provided by Tutors, Students and Institutes.
Minimum Age for tutors
A Tutor warrants that he is of at least eighteen years of age, has the necessary qualifications and/or experience to provide tuition in the subjects specified by the Tutor on the Website.
Claims
A Tutor shall indemnify PakistanTutor.com from all claim liabilities costs and expenses (actual or consequential) of every kind and nature known and unknown, suspected and unsuspected disclosed and undisclosed arising out of any use by the Tutor of the Website.
Display of Personal Information is not allowed
A tutor and a tutorial centre will not include personal email, contact numbers etc. in the form fields like Tutoring Experience, Tutoring approach, other topics. Adding contact details except specific fields is not acceptable in any condition and this kind of recurring attempt may suspend that profile.
Hate speech is not allowed
In responding to feedback of Students posted on the Website a Tutor shall not be personally abusive about a Student or his nominee.
Accuracy Of your information
A tutor and a tutorial centre accepts full responsibility for all information published by him on the Website and shall indemnify PakistanTutor.com in relation to any liability incurred by them as a result of such information.
A tutor and a tutorial centre hereby acknowledges that PakistanTutor.com are not liable to the Tutor for reimbursement of any fees paid pursuant to these Terms in the events of any cancellation of any Contract or Tuition for any reason.
Tutors are not an employees of PakistanTutor.com
A Tutor acknowledges that he is not an employee of PakistanTutor.com and accepts full responsibility for all Income Tax and other liabilities payable in relation to any fees generated from a tuition contract. We do not issue any working experience certificate to our registered members.
Profile may show up in Search Engines
A tutor or tutorial centre undertakes to register for the PakistanTutor.com service using accurate and current information about him/her - including correct name, address, telephone number, qualifications and any other requested details. Via PakistanTutor.com:
Clients or Students can select to pay tutors via PakistanTutor.com and can request PakistanTutor to pay tutors at the end of each tutoring period, session or agreed term. PakistanTutor.com takes 5% of each fee as a tutor payment handling fee.
- All payments are paid via PakistanTutor.com and we keep 5% of each fee as a tutor payment handling fee.
- We take 50% commission of first fee.
Courses and Classes:
Any registered tutor or centre and guest users can create their own relevant "Courses and Classes". Students can view your contact details after booking. For any delay and cancellation of any Course and Class, the respective tutor / trainer / centre is solely responsible. And refunds of booking fee will be given at the discretion of the Company Management.
PakistanTutor.com is not responsible if you are unable to convert tuition enquiries through our 'Single Lead Purchase' facility. This facility generates maximum effectiveness if you purchase the enquiry on the day of posting, instead of waiting for the price to reduce. However, we would not be accountable for any inconvenience caused.

1. What is PakistanTutor?
1.1 PakistanTutor is an elearning website and online platform through which Tutors and Tuition centres can offer private home and online tuition, one-on-one tutoring, group classes, elearning courses, to the users of this website or general public. Tutors using the Website provide expert private tuition to Students at all levels from Key Stage 1 up to postgraduate level.
1.2 Tutors are self-employed. They are not employed or engaged by PakistanTutor and are not the responsibility of PakistanTutor. We just manage their online data, provide you contact details of tutor you desire or for any tutor of the subject you want to learn.
1.3 PakistanTutor strive hard to perform quality checks using its Online Testing System. The inclusion of a Tutor into our website or database does not constitute a representation or warranty by PakistanTutor that such Tutor is suitable and qualified to provide the tuition which he provides through the Website.
1.4 Although we work hard check the authenticity of the information submitted by tutors by verifying their CNIC number, Address, Degree, Cell Number and Facebook, we cannot guarantee the accuracy of the data tutors are showing in their profile. Tutors do have rights to edit their profile with some limitations that may allow them to change information they verified at the time of registration.
2. What are these terms of service?
2.1 These Terms of Service set out the terms on which PakistanTutor offers the Website and the Services for students.
2.2 Please review these Terms of Service carefully and make sure that You understand them before using the Website and/or the Services. If You do not agree to these Terms of Service, You must cease use of the Website and the Services immediately.
3. Definitions
Free Trial
means a free trial Session with a Tutor during which the Student can evaluate the suitability of the Tutor for the tutoring he requires.
Services
means all those services provided through the Website by PakistanTutor. These include the provision of the Website, the content contained therein and the medium through which Students can access Tutor Services. The Services do not include Tutor Services.
Sessions
means any period of time during which a Tutor is interacting with a Student via the facilities offered through the Website or at agreed location for home tutoring.
Student
means any user of the Tutor Services.
Tutor Services
means all those services provided through the Website by a Tutor. These include the provision of Sessions and all matters related thereto.

means any website published by PakistanTutor from time to time including without limitation the website at www.pakistantutor.com and its subdomains, any associated social networking profiles and any applications for mobile devices published by PakistanTutor from time to time.
4. Acceptance of these terms of service
4.1 By using the Website, You accept and agree to be bound by these Terms of Service.
4.2 PakistanTutor may at any time modify these Terms of Service. We will notify You of any changes to these Terms of Service either by emailing You (at the email address entered by You into the registration form on the Website) and/or by posting a notice on the Website. By continuing to use the Website after changes to these Terms of Service are made and notified to You, You agree to be bound by such changes.

5. Your conduct
5.1 You agree and undertake to:
(a) keep Your username and password confidential, not to disclose Your password to any other person and not to permit any other person to log in to the Website using Your username and password; and
(b) treat Your Tutor with respect and to refrain from abusive, racist, homophobic, sexist or defamatory language at all times.
5.2 Your protection and safety is of great importance to us. For this reason You must never give Your personal contact details to any Tutor. This includes Your [Skype] (or other online chat) username, telephone number, email address, home address or Facebook (or other social networking account) username. In the event that a Tutor requests any such information, You undertake and agree to tell Your parent, guardian and/or teacher (where You use the Website at school) straight away and to simultaneously notify PakistanTutor.
5.3 You undertake and agree not to attempt to, or to actually, contact any Tutor other than through the Website or via PakistanTutor.
5.4 By downloading and/or using the Website, You agree not to:
(a) upload, post, e-mail or otherwise send or transmit any material that contains viruses, Trojan horses, worms or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Website;
(b) attempt to reverse engineer or sell, export, license, modify, copy, distribute or transmit the Website to any third party, or jeopardize the correct functioning of the Website, or otherwise attempt to derive the source code of the software (including the tools, methods, processes and infrastructure) that enables or underlies the Website;
(c) attempt to gain access to secured portions of the Website to which You do not possess access rights;
(d) impersonate any other person while using the Website;
(e) conduct Yourself in a vulgar, offensive, harassing or objectionable manner while using the Website;

5.5 Any breach of the obligations in this paragraph 5 will lead to the automatic and immediate termination of Your access to the Website.
6. Our rights
6.1 In providing You with access to the Website, PakistanTutor reserves the following rights, and in accessing, browsing or otherwise using the Website You grant to PakistanTutor and agree that PakistanTutor shall have the following rights:
(a) the right to refuse or withdraw Your access to the Website in accordance with applicable laws for any reason at any time (with or without notice) if in PakistanTutor’s sole and absolute discretion You violate or breach any of these Terms of Service;
(b) the right to amend or update the Website, billing methods or these Terms of Service from time to time;
(c) the right to report You to the police or other judicial body if PakistanTutor believes in its sole and absolute discretion that Your conduct is or may be unlawful; and
(d) the right to remove any Tutor from the Website and prevent any Tutor from providing the Services.
6.2 You acknowledge and agree that we may record and/or monitor some or all sessions that You undertake with a Tutor for the purposes of crime prevention and to ensure that users do not breach any provision of these Terms of Service.
6.3 PakistanTutor will store, use and disclose any recordings we make in accordance with our Privacy Policy which can be found at the bottom of the Website by following the link ‚ÄúPrivacy Policy‚Ä?. As set out in the Privacy Policy, PakistanTutor may disclose any recording to the police or other appropriate law enforcement agency without Your consent if PakistanTutor believes in its sole and absolute discretion that You or a Tutor have broken the law.
7. Free trials
7.1 In order to start using the Services, You must choose a Tutor using the Website and commence a Free Trial. During a Free Trial You may undertake a single Session with a Tutor without charge. This can be online or at your designated place. During the Session, You will have the opportunity to discuss Your learning objectives with the Tutor and to experience the Tutor’s teaching style. You are only permitted one Free Trial with each Tutor. You are permitted to undertake a Free Trial with more than one Tutor. However, PakistanTutor reserves the right to prevent You from undertaking Free Trials where it considers in its sole and absolute discretion that Your usage of Free Trials is more than is reasonable.
7.2 No Tutor is obliged to permit You to undertake a Free Trial with him. Furthermore, no Tutor is obliged to permit You to commence further paid Sessions with him. By booking a Free Trial with a Tutor, You request a Free Trial. Occasionally, the Tutor my refuse to accept the request. This may be because he does not have capacity or because he does not feel that he is suited to Your educational needs.
8. Booking a session
8.1 You can hire a tutor either after searching for tutor profile and then submitting a request to hire this tutor or simply asking PakistanTutor to help you find a tutor.
8.2 In both cases, you get contact details of either your selected tutor or matching tutors from same location or online. Once you are provided with contact details, you need to select a tutor to get a free one day trial.
8.3 When You have completed Your Free Trial, You may wish to undertake further sessions with a Tutor with whom You have undertaken a Free Trial. This option is available only for online tutors and online tutoring. In order to undertake further Sessions, You must purchase one or more Sessions through the Website. By purchasing one or more Sessions, You enter into a direct contract with the Tutor for the provision of the Tutor Services. The price charged for a Session includes the Fee payable to the Tutor, PakistanTutor’s fee for provision of the Website and any applicable VAT. You must never make any additional payment to a Tutor or provide a Tutor with your bank account, PayPal or card details.
8.4 If you want to get free trial from another tutor, you need to contact PakistanTutor via email or phone or otherwise any other available method. PakistanTutor will then arrange a suitable tutor for you.
8.5 You can ask for trial from maximum 3 tutors. If you are not able to select any tutor after trials from three tutors, PakistanTutor will charge you minimum fee of PKR 2000 or $20 per every new trial from any tutor.
8.6 Once you are satisfied with a tutor and wants to hire, you must submit a request to PakistanTutor. PakistanTutor will take necessary steps to provide you tutor.
8.7 Students are not allowed to hire any tutor without notifying to PakistanTutor. It is also against our Best Practices To Hire A Tutor
. In case you hire a tutor directly and do not notify PakistanTutor, a legal action may be taken against you.
8.8 Tutors are self employed and act on a freelance basis. They are not employed or otherwise under the control of PakistanTutor except the terms and conditions provided at

and their use of this website to get our tuition jobs. Tutors do not have any the power to bind PakistanTutor.8.9 Sessions are non-transferable and a Session can only be used only for the Tutor with whom the Session was booked.
8.10 In the event that You wish to use a different Tutor, You must purchase separate Sessions with that Tutor.
8.11 In the event that a Session is postponed or cancelled by You in accordance with clause 9.1 or otherwise by the Tutor, or if the Session cannot take place due to the occurrence of an event detailed in clause 9.3, You must notify PakistanTutor within 24 hours of the scheduled time and date of such Session. Failure to notify PakistanTutor may result in You being charged for such Session. This applies only to online tutors or online tutoring.
9. Payments
9.1 If you hire a home tutor, online tutor, buy a session, online classes or tutorials, all payments are received in advance.
9.2 In case of you buy online tutoring, video tutorials, or any other online service, you must submit all your payments online in advance using either Skrill, PayPal or Mobile money transfer system. You are responsible to pay all transfer charges.
For example:
If you buy a video tutorial for $50 or PKR 5000, PakistanTutor must receive $50 or PKR 5000 without any deduction for transfer charges.9.3 In case you hire a home tutor, you have to options to pay your advance payment to tutors.
(a) Direct pay:
First fee should always be paid to PakistanTutor. Second and onwards fee can be paid directly to tutors.
(b) Escrow:
You make advance payment to PakistanTutor. PakistanTutor keeps your payment and pay to tutor at the end of tutoring period, month or session, whatever you have agreed with a tutor.i - All payments will have maximum of 5 days margin from the date they are due. For example, if your fee or payment is due on 23rd of each month, you can make your payments by 28th.
ii - In case you are not able to make payment within 5 days after due dates, tutors have right to stop tutoring until they receive their funds.
iii - In this system you are eligible for refund as per refund policy set forth by PakistanTutor at its whole discretion.
10. Cancellations and refunds
10.1 In the event that a Student wishes to cancel a Session with a Tutor, he must notify the Tutor no less than 5 hours prior to the allotted appointment time. If less than 5 hours notice is given, the Student will be charged the full amount for the Session.
10.2 In the event that a Student believes that the Tutor Services are not suitable, he may not cancel any Sessions and/or transfer any Sessions to another Tutor. In very rare circumstances, in the sole and absolute discretion of PakistanTutor, a Student may be permitted to transfer any unused Sessions to another Tutor.
10.3 In the event that a scheduled Session cannot take place due to a failure in the Website or some other matter the responsibility of PakistanTutor, the Tutor and the Student may agree to postpone the Session and undertake the relevant Session at a mutually convenient time.
10.4 Refunds are not available for any Sessions or classes purchased by a Student.
11. Quality of tutor services
11.1 PakistanTutor is not responsible for the quality of Tutor Services or for the non-performance of Tutor Services by a Tutor.
11.2 In the event that a Student believes that a Tutor has not performed the Tutor Services, has been deficient in the performance of the Tutor Services or there is an unresolved dispute with a Tutor, the Student should contact PakistanTutor who will endeavour to resolve such matter.
11.3 The Student acknowledges and agrees that the provision of Tutor Services is the sole responsibility of the Tutor and that PakistanTutor is not liable for any aspect of the performance of the Tutor Services.
12. Reviews
12.1 You can review a Tutor with whom You have undertaken a Session. Reviews are published in the sole and absolute discretion of PakistanTutor. PakistanTutor may summarise, abbreviate and/or rephrase any review submitted by You. PakistanTutor may decline to publish a review where PakistanTutor considers in its sole and absolute discretion that the review is unfair, inaccurate or otherwise where there is a dispute with the Tutor.
12.2 By writing and submitting a Review, You grant to PakistanTutor an irrevocable licence to publish such review in full or abbreviated form on the Website or any other medium including without limitation its social networking profiles.
12.3 PakistanTutor will never publish Your full name in connection with any review without your prior consent.
13. Intellectual property
13.1 PakistanTutor and/or its licensor(s) are the sole owners of the Website.
13.2 PakistanTutor brand and the Website are protected by Pakistan and International copyright and other intellectual property laws. We permit You to use the Materials for non-commercial use only and we grant You a limited license solely for that purpose. With limitation, this means that You may not sell, license, modify, copy, distribute or transmit the Website (or any part of it) or any material provided through the Website or as part of the Services for any commercial purpose or for any other reason without PakistanTutor’s prior express written consent.
13.3 Materials provided by a Tutor and any concepts, models or other tutoring tools shall belong to the Tutor. The Tutor grants the Student a limited revocable licence to use such material solely for the purposes of participating in the Tutor sessions. Without limitation You may not distribute, copy, sell or otherwise use any such material without the prior written consent of the Tutor.
13.4 You are not permitted to record any Tutor session under any circumstances. Any recording of any Tutor session shall belong to PakistanTutor and shall not be reproduced for any reason without the prior written consent of PakistanTutor.
13.5 Any unauthorized use of the Website will result in the automatic termination of the limited license granted by us. PakistanTutor reserves the right to terminate the limited license without notice at any time following an unauthorized use by You of the Website.
13.6 PakistanTutor and its graphics, logos, icons and service names related to the Website are registered and unregistered trademarks or trade dress of PakistanTutor. They may not be used without PakistanTutor’s prior express written permission.
13.7 All other trademarks not owned by PakistanTutor that appear in connection with the Website are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by PakistanTutor.
14. Electronic communications
14.1 You consent to receiving electronic communications and notices from PakistanTutor and any Tutor with whom You book a Free Trail or purchase one or more Sessions. You agree that any notice, agreement, disclosure or other communications that we send to You electronically will satisfy any legal communication requirements, including that such communications be in writing.
15. Privacy
15.1 You provide us with information when You register on the Website and/or use the Services. We may store such information and use it to improve the Services we provide through the Website. Any information that You submit or that we collect when You are using the Website is subject to PakistanTutor Privacy Policy, the terms of which are hereby incorporated into these Terms of Service.
15.2 PakistanTutor continually tries to keep all information secure from unauthorised access by using SSL encryption on sensitive data. However, transmission over the Internet cannot be guaranteed to be 100% secure, so any information You submit is done so at Your own risk.
15.3 Whilst we have implemented commercially reasonable technical and organisational measures to secure Your personal information from unauthorised use, we cannot guarantee that unauthorised third parties will never be able to defeat those measures. You acknowledge that You provide Your personal information at Your own risk.
16. No warranty and liability limit
16.1 PakistanTutor provides the Website "as is" and without any warranty or condition, whether express, implied or statutory. PakistanTutor specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement to the extent permissible under the Sale of Goods Act 1979 (as amended).
16.2 PakistanTutor assumes no liability or responsibility for any errors or omissions in the Website; any losses or damages arising from the use of the Website and/or the Services; or any harm to Your reputation or losses resulting from any disclosure of information about You by us as permitted in these Terms of Service. We reserve the right to deliver the Website and the Services in our sole and absolute discretion.
16.3 PakistanTutor is not responsible for the provision of Tutor Sessions by Tutors.
16.4 In no event shall PakistanTutor, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to You for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the Website, the Services or these Terms of Service, on any theory of liability, and whether or not advised of the possibility of damage.
16.5 PakistanTutor does not seek to exclude liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation on the part of PakistanTutor. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
16.6 From time to time You may use or access services, promotions and websites of third parties. In using or accessing third party services, promotions and websites, You agree to be bound by the terms of service of such third parties governing their services, promotions and websites and hereby acknowledge that we shall not be responsible for the provision of services, accuracy of promotions or content of websites belonging or operated by third parties.
16.7 PakistanTutor specifically excludes liability for any loss, harm, distress or damage suffered by You or any third party as a result of inaccurate information appearing on the Website.
16.8 Use of a Tutor is no guarantee of a certain result. No Tutor offers any guarantee that a Student using his services will reach a particular standard or pass any examination. By using the Website and any Tutor, You irrevocably disclaim any claim You may have against such Tutor in respect of the quality of tutoring provided by the Tutor and/or the content, format, method or other approach to any tutoring session provided by such Tutor.
17. Interruptions and suspension of the website
17.1 PakistanTutor does not guarantee the uninterrupted operation and availability of the Website. From time to time, the Website may be unavailable for any number of reasons including without limitation:
(a) the performance of scheduled maintenance including on servers and data lines;
(b) the performance of emergency unscheduled maintenance and/or repairs including on servers and data lines;
(c) a failure by or error in respect of any service provider including without limitation any server or data line;
(d) an attack on the security or system integrity of the Website including any denial of service attack; and
(e) the introduction or presence of any virus or malicious code in the pages that make up or are accessible from the Website.
17.2 For the avoidance of doubt, without prejudice to the provisions of paragraph 15, PakistanTutor shall not be liable for and specifically disclaims any liability in respect of any claims, costs, losses or damages suffered as a result of any suspension or interruption to the Website howsoever caused.

You agree to indemnify and hold PakistanTutor and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of Your breach of these Terms of Service and/or Your violation of any law or the rights of any third party.
19. Disputes
19.1 You agree that these Terms of Service and any claim, dispute or controversy arising out of in connection with these Terms of Service or their subject matter or formation (including non-contractual disputes or claims), the Website, PakistanTutor’s advertising or any related transaction between You and PakistanTutor shall be governed by and construed in accordance with English law.
19.2 Any dispute or claim arising out of or in connection with such matters (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales.
20. Termination
PakistanTutor may change or discontinue the availability of the Website or any part thereof at any time without prior notice. 21.3 These Terms of Service are agreed between You and us. No person shall have any rights under or connection with these Terms of Service under the Contracts (Rights of Third Parties) Act 1999.
21.4 If any court or competent authority decides that any term of these Terms of Service is held to be invalid, unlawful or unenforceable to any extent, such term shall, to that extent only, be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by law.
